How to Cancel a Mobile Contract in Germany (Kündigung)
Cancelling (Kündigung) a German mobile phone contract requires adherence to specific procedures defined in the contract and in German telecommunications law. This guide explains the notice requirements, acceptable cancellation channels, what information to include, and how to handle situations where the provider does not confirm receipt.
When Can You Cancel
The right to cancel depends on your contract type:
- Fixed-term (24-month) contract: You can cancel at the end of the minimum term with one month's notice (under TKG 2021). After the minimum term, the contract converts to monthly and can be cancelled at any time with one month's notice.
- Monthly contract (monatlich kündbar): Cancel at any time; takes effect after one calendar month from the cancellation date.
- Mid-contract: Standard cancellation is not available mid-term without penalty, unless an extraordinary cancellation right applies.
Required Notice Period
Under the Telekommunikationsgesetz (TKG) 2021, the standard notice period for consumer mobile contracts is one calendar month. The notice period begins from the date the cancellation is received by the provider — not from the date it is sent.
Practical implication: If your contract ends on November 30, send the cancellation no later than October 31 (to ensure it is received before October 31). Sending by registered mail (Einschreiben) on October 28–29 is safest to allow delivery time.
Written Form Requirement
German mobile contracts historically required cancellation in written form (Schriftform), meaning a signed physical letter sent by post. The TKG 2021 introduced an important update:
- Providers must offer at least one electronic cancellation option — either a web form, email, or app-based cancellation.
- A fax or email cancellation is legally binding if the provider's contract or general terms accept it (most now do).
- Online provider portals (Kündigungsformular) are increasingly common and generate automatic confirmation receipts.
Despite electronic options, sending a cancellation by registered letter with acknowledgement of receipt (Einschreiben mit Rückschein) remains the most legally robust method, as it provides documented proof of both sending and receipt.

- Requested cancellation date (end of minimum term, or earliest possible date)
- Request for written confirmation (Kündigungsbestätigung)
- Date and signature (for postal cancellations)
Using the phrase "zum nächstmöglichen Termin" (at the earliest possible date) ensures the contract ends as soon as legally possible even if you do not know the exact date.
Requesting and Keeping Confirmation
Providers are legally required to confirm receipt of a cancellation in text form (TKG 2021). Always:
- Request written confirmation of cancellation (Kündigungsbestätigung) in your cancellation letter.
- If using online form, screenshot and save the confirmation page and any confirmation email.
- Keep all cancellation correspondence for at least 12 months after the contract end date.
- If no confirmation is received within 7–14 days, follow up with the provider. Escalate to the Bundesnetzagentur (Federal Network Agency) if the provider refuses to confirm.
Extraordinary (Immediate) Cancellation
In certain circumstances, the contract can be cancelled immediately (fristlose Kündigung) without serving the standard notice period:
- Unilateral price increase or material term change by provider: The consumer may cancel immediately, effective on the date the change would take effect. The provider must inform the consumer at least one month in advance.

After Cancellation
- The SIM card and phone number remain active until the contract end date.
- All services continue normally until the cancellation date.

- Return any rented equipment (e.g., router if on a combo plan) within the required period to avoid equipment fees.
